Carl Schmitt, one of the most influential legal and political thinkers of the twentieth century, is known chiefly for his work on international law, sovereignty, and his doctrine of political exception. This book argues that greater prominence should be given to his early work in legal studies. Schmitt himself repeatedly identified as a jurist, and Hugo E. Herrera demonstrates how for Schmitt, law plays a key role as an intermediary between ideal, conceptual theory and the messiness and complexity (...) of practical, concrete situations. Law is concerned precisely with balancing the extremes of theory and reality, and in this respect, Schmitt associates it with philosophical thinking broadly as being able to understand and explain the tensions in human experience. Reviewing and analyzing prevailing interpretations of Schmitt by Jacques Derrida, Heinrich Meier, and others, Herrera argues that the importance of Schmitt's legal framework is both significant and overlooked. According to mostly known interpretations (e.g.: Hofman, Strauss, Löwith or Kuhn), the legal and political thought of Carl Schmitt keeps distance from Aristotle's. This article intends to show that Schmitt's concept of law, despite developed in a different context, holds significant likelihood with Aristotle's comprehension of law. Two Approaches to the EarthIn several postwar texts, the earth increasingly receives attention from Carl Schmitt.1 In The Nomos of the Earth, the most important of these texts, he refers to Friedrich Hölderlin, a much earlier, very different author, who also considers the subject of the earth. Even though the positions of both are, ultimately, quite similar, they maintain significant terminological differences. Schmitt and Hölderlin both employ the word “nomos,” but in very different ways. Hölderlin regards “nomos” as (...) “law” in the sense of “positive” norm or “Gesez.”2 This use of “nomos” as “Gesez” differs from a second notion of law as the meaning operating at the basis of what Hölderlin calls the “sphere.” The sphere is a meaningful whole in which man originally exists. Law is here the very relations of the sphere as a meaningful whole. Hölderlin calls it the law in a “negative” sense.3 This second notion of law by Hölderlin (negative law or law as the meaning at the basis of the sphere) coincides precisely with the Schmittian idea of “nomos” as an “order of meaning [Sinnreich],”4 what he also calls the law in an “ontonomous and existential” sense.5 The first use of law as “nomos” or “Gesez” by Hölderlin coincides with Schmitt’s use of “Gesetz”: of law as “positive” law. Alexandre Kojève had traveled via Peking. The high official of the French Ministry of the Economy stopped off in Berlin in order to speak to the heads of the German Socialist Student Association. In the Hotel Berliner Hof on Lake Diana, the Parisian guest advised Dutschke & Co. that the most important thing they could do would be to learn Greek. Such an answer to the question “What is to be done?” was not expected from this famous man, whose legendary (...) seminars on Hegel's Phenomenology of Spirit in the Thirties had inspired an entire generation of French scholars and intellectuals. Kojève's long-standing acquaintance, who looked after his guest during his stay in Berlin, was no less baffled to hear from the Hegelian that his next stop was Plettenberg. “Where else should one travel to in Germany? En el presente trabajo pretendo mostrar que el pensamiento de Carl Schmitt tiene un carácter marcadamente filosófico. Más precisamente: que en la base de él se halla una teoría de la comprensión. Esa teoría de la comprensión tiene la particularidad de que se desarrolla a partir de una teoría de la comprensión jurídica, pero se extiende, en su obra, a la comprensión en general.

Dans ce chapitre publié en 1894, Heinrich Waentig (1870-1943) ne présente pas Comte comme une victime qu’il s’agirait de défendre. Il essaie plutôt de marginaliser les critiques de Comte qui dominent l’espace académique germanophone à cette époque. Il insiste sur le « triomphe » annoncé de la méthodologie comtienne, répond aux critiques de Dilthey et reprend certains arguments de son maître de Leipzig, Wilhelm Wundt. Waentig rend hommage à la méthode comparative qui permet de dégager les faits typiques d’une (...) manière beaucoup plus pertinente que celle adoptée par l’économiste Carl Menger. Inquiries of Wellstein, Grünbaum and others have proved that there are indefinitely many different spatial models of Euklidian geometry. The points, lines and planes of these models are related to each other as the points, straight lines and planes of Euklidian geometry, but they are obviously totally different from them. That means that the axiomatic Euklidian geometry does not clearly determine the spatial forms of their planes and straight lines. The constructive geometry basing on approaches of Hugo Dingler tries (...) to solve this problem of disambiguity so that a clear realization of the geometrical basic objects plane, straight line and rectangle and others is possible because of certain rules. On the one hand these rules are to pledge the techniques of realisation and on the other hand they are the basic for the deduction of statements on the technically realized geometrical basic objects. The rules are especially to pledge the selection of apt material that keep its form. The following will show that the disambiguity cannot be pledged by the mere laws established by the constructive geometry and especially that the problem of electing the material cannot be solved by these laws. Furthermore it proves to be necessary to analyze and reconstruct more circumstances describing the selection of apt material which exceed the present standard of constructive geometry. (shrink)

Carl Heinrich Seibt’s Prague Lectures on the Schöne Wissenschaften: The Beginnings of Aesthetics in Bohemia Carl Heinrich Seibt (1735–1806) was the founder of modern Bohemian aesthetics, that is, thinking about taste, beauty, and fine art, which he developed in a living language. Yet little is known about the content of his lectures on the Schöne Wissenschaften or his views on aesthetics. The following article aims to fill this gap in four respects. It explains why the topic (...) has so far been neglected; it gives a summary of the now known sources from which we may draw our knowledge of the topics of art theory, the individual kinds of art, and general aesthetics, with which Seibt was concerned in his lectures. It presents the standpoints which he held in them, and it puts them into the European context of the period, particularly German aesthetics. It aims primarily to determine whether the accessible sources contain traces of influences other than those of his teachers at Leipzig, who are mentioned in the secondary literature: Johann Christoph Gottsched (1700–1766) and Christian Fürchtegott Gellert (1715–1769), including the important authorities recognized by them, in particular Charles Batteux (1713–1780). The article shows that Seibt’s views were also influenced by Moses Mendelssohn and Johann Joachim Winckelmann, representatives of a generation of German aestheticians younger than his teachers. Carl Schmitt and Leo Strauss are undoubtedly two of the most influential and radical conservative critics of liberalism of our century. Their work takes aim at the heart of liberalism: it questions the consistency of liberalism’s theologico-political ground, namely, the separation of church and state. They take exception to the neutrality of the liberal state with respect to matters of faith on the ground that such neutrality betrays a lack of absolute moral commitments and places liberalism in a chronic (...) crisis of legitimacy. Schmitt advances his critique of liberalism from the standpoint of political theology. This discourse claims that the political state is authoritative in virtue of its capacity to equate the individual decision of whether or not to obey unconditionally a given legal order with the absolute decision between good and evil, to which the individual has access only through religious faith. Whether the standpoint of Strauss’s critique falls within the purview of political theology is one of the questions that will be discussed in this review. More importantly, their respective critiques of liberalism raise the topical question of the nature of the relation between liberalism and politico-religious fundamentalism. (shrink)

In this volume, Heinrich Meier sets out to present what is “of lasting importance in [Schmitt’s] political theology”. The four chapters seek to develop the theme of the radical “eitheror” that faces human beings in Schmitt’s thought. Meier argues the distinction between political theology and philosophy rests on their fundamental causes—faith in revelation and human wisdom. Schmitt’s political theology and the choice he sees forced on mankind derives from the eschatological view of history found in revelation, in particular the (...) final battle with the anti-Christ. There is a fundamental existential alternative between God and the anti-Christ that has an attendant choice between political theology and political philosophy. Coupled with this treatment of the existential necessities of being human is a presentation of Schmitt’s critique of the modern liberal state and a report on his analysis of Hobbes’s Leviathan. The book concludes with a chapter entitled “History, or the Christian Epimetheus” that considers the ethical ramifications of Schmitt’s view of history and examines his thought in light of his endorsement of National Socialism and his anti-Semitism. Through a discussion of Hugo Grotius’ conception of just war, this essay shows that within his critique of liberalism, Schmitt clashed with the very intellectual tradition he claimed to represent. Both historically and philosophically Schmitt's concept of the Ius Publicum Europaeum was a mirage.
